Liability Waiver & Release of Claims

This Liability Waiver (“Waiver”) is a legal agreement between LA DRVNG (“Company,” “we,” “our,” or “us”) and the client (“Client,” “you,” or “your”). By booking or participating in any driver education instruction service, you acknowledge that you have read, understood, and agree to the terms below. This Waiver should be read together with our Terms & Conditions, Privacy Policy, and Refund Policy.
If you do not agree to these terms, do not schedule or participate in any lesson.
1. Assumption of Risk
Driving a motor vehicle involves inherent risks, including but not limited to:
- Collisions
- Property damage
- Personal injury
- Injury to others
- Exposure to unpredictable road conditions
- Mechanical failure
By participating in driver education instruction, you voluntarily assume all risks associated with operating a vehicle, whether during a lesson, practice session, or DMV test.
2. Client Responsibilities
You agree to:
- Follow all instructions provided by the instructor
- Drive safely and responsibly
- Present a valid California learner's permit or driver's license
- Notify the instructor of any physical or medical conditions that may affect your ability to drive
- Refrain from driving under the influence of alcohol, drugs, or impairing substances
Failure to comply may result in immediate termination of the lesson without refund.
3. Release of Liability
To the fullest extent permitted by law, you agree to release, waive, and discharge L.A. DRVNG, its owner, instructors, employees, contractors, and affiliates from any and all claims, liabilities, damages, losses, or expenses arising from:
- Personal injury
- Property damage
- Accidents occurring during or after instruction
- Actions taken by you while operating a vehicle
- Actions taken by other drivers, pedestrians, or third parties
This release applies whether the incident occurs:
- During a lesson
- While driving to or from a lesson
- During DMV test preparation
- After instruction, when driving independently
This release does not apply to claims arising from the Company's gross negligence, recklessness, or willful misconduct, or to the extent otherwise prohibited by California law.
4. Vehicle Use
Lessons may be conducted in a Company-owned vehicle or a Client-provided vehicle (if approved).
If using your own vehicle, you acknowledge that:
- You are responsible for ensuring the vehicle is safe and legally compliant
- You assume all liability for damages or injuries resulting from the vehicle's condition
5. Insurance
The Company maintains insurance for Company-owned vehicles. However, this does not replace your personal responsibility as a driver. You understand that:
- Insurance coverage may not apply if you violate safety instructions
- You may be personally responsible for damages caused by reckless or negligent behavior
6. Indemnification
You agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising from:
- Your actions during instruction
- Your violation of traffic laws
- Your failure to follow instructor guidance
- Your operation of a vehicle outside of scheduled lessons
7. Medical Conditions
By participating, you confirm that:
- You are physically and mentally capable of operating a motor vehicle
- You do not have any condition that would impair your ability to drive safely
If you have a condition that may affect driving, you must disclose it before the lesson.
8. In-Vehicle Recording (Dash Camera)
The Company's vehicle is equipped with a dash camera that records continuous video, and audio, of the vehicle interior and roadway during all lessons. This recording is standard practice for every lesson and is used for:
- Driver and passenger safety
- Documentation in the event of an accident or insurance claim
- Instructor training and quality review
By booking or participating in a lesson, you consent to being recorded, including your voice, on both video and audio, for the duration of the lesson. If the Client is a minor, this consent must also be given by a parent or legal guardian. Recordings are retained only as long as reasonably necessary for the purposes above and are not shared publicly. Recordings may be shared with our insurance carrier or legal counsel in connection with an accident, claim, or legal request, and as otherwise described in our Privacy Policy.
9. Acknowledgment of Understanding
By booking or participating in a lesson, you (or, if the Client is a minor, the Client's parent or legal guardian) acknowledge that:
- You have read this Waiver in full
- You understand the risks associated with driver education instruction
- You agree to the terms voluntarily
- You are legally capable of entering into this agreement, or are the parent or legal guardian of a Client who is a minor and are entering into this agreement on their behalf
- You consent to the in-vehicle recording described in Section 8
